In October 2006 Tunbridge Wells Borough Council's Head of Planning Services Jim Kehoe granted consent: "Lawful Development Certificate (Existing) Off road parking for motor vehicles ancillary to a commercial use" (TW/06/02750/CEU)

Residents ask for the revocation of the Certificate of Lawful Use as TWBC failed to consider:
- the purely residential status of the area, its amenities and the adjacent private gardens
- the Conservation Area with the Listed Buildings and Trinity's Listed church wall (the impact on the settings)
- the Community Plan 2006-2011, the Statement of Community Involvement, the Local Development Framework (LDF)
- Highways Safety and the Central Access Zone (Residential)
- the fact of NON-payment of Business Rates in the past.
