I should explain that the Department is unable to comment on the details of a specific case which may formally come before the Secretary of State on appeal, or on the actions of a particular local planning authority. Successive Governments have decided that the day-to-day planning functions, such as formulating development plan policies, determining planning applications and enforcing planning control, are best carried out by the democratically elected local councils.
The interpretation of planning guidance notes is also ultimately a matter for the courts, and it would therefore also not be appropriate for me to comment on the wordings you have highlighted.
