Telephone House Development - Local Plan Review - Policy H6(a)
Thank you for your letter of 18th July 2001.
I am glad to hear from you that Tunbridge Wells Borough Council is taking Counsel's opinion on challenging the Inspector's Decision in High Court.
Although you feel that the chances of success are negligible, we suggest that as a first step Policy H6(a) be removed from the Local Plan Review, as there seem to be enough grounds to show that it should not have been included.
Have you sought Counsel's opinion on the assumption that Policy H6(a) be part of the Local Plan Review, or would you be prepared to support our request to remove this policy first, and then to challenge the Inspector's decision in High Court?
Please inform the Operational Services Board of the contents of this letter at the meeting on Thursday 26th July 2001.
