Proposed Development at the Telephone House site - Right to Light

Dear Mr Harris,

As one of those most affected by the proposed development at the Telephone House site directly opposite me, I would like your advice.

Following a recent letter on the 1st May 2002 by the Telephone House Neighbours Association to Mr. John Haynes, it appears the developer introduced incorrect evidence about loss of light caused by proposed buildings.

In a previous letter from me to the Planning Department, I pointed out my concerns about the light studies commissioned by the developer and prepared by Schatunowski and Brooks (my letter 09.08.2000). It now appears that these diagrams were not accurate.

If I am correct, I would be grateful for your professional advice on the following:

1. Can the Council and / or I stop the development, as the permission was granted on the wrong advice?
   • Will my rights and those of my neighbours be protected if plans are amended?
2. Even if the plans are amended we will still obviously suffer some loss of light.
   • Do we have a potential claim for compensation against the developers?
3. Will the claim be stronger if the developer cannot be persuaded to amend their plans?
4. If we cannot claim compensation from the developers, do we have a statutory claim against TWBC for failing to bring the false evidence to the notice of the Inspector at the time of the appeal in May 2001?
