TELEPHONE HOUSE DEVELOPMENT - RIGHT OF LIGHT
Thank you for your letter dated 1 May, 2002, in which you reiterate your request for the Council to pay your costs for a light survey.
I have previously advised that if you wish to pursue a right of light issue, you need to make an application to the Councils Land Charge Register, under Section 2, of the Right of Light Act 1959. I do not believe that I can advise further on this matter but have copied your letter and this reply to our Borough Solicitor so that he can advise you direct, or via myself, should he consider there are any new material matters raised in your letter, which would warrant different, or further action by the Council on this point, at this time.
Incidentally, the Borough Solicitor is also the Senior Manager responsible for the Council's Land Charges Section. Therefore, should you decide to pursue the matter by applying to the Land Charges Register, he would be dealing with the matter and hence a further reason, I consider, for drawing him into this matter, at this stage.
