Thank you for your letter of 8 September, and indeed for the comments on the submitted Scheme of Works sent on 18 August.
I have given careful consideration to the Scheme of Works, to CALA's supplementary letters and to the views of the THNA. I am not satisfied that adequate protection is being given to the amenities of residents of York Road and I have decided to refuse the Scheme of Works. I attach a copy of the formal decision notice.
You raised two further issues in your letter.
On the issue of maintaining the structural integrity of the buildings in York Road, I do not accept that this is the responsibility of the Local Planning Authority. It seems to me that this is likely to be a matter between individual property owners and the developer or contractor involved in the construction process.
Regarding rights of light, I do not consider that this issue has any bearing on the discharge of Condition 15, which relates entirely to the submission and approval of the Scheme of Works.
I would be happy to discuss any of these issues if you consider it would help.
